Westnet Member-Referral Terms & Conditions
Information on how to enter into the Member-Get-Member competition (the “Promotion”) and the corresponding prizes form part of these Terms and Conditions, including information on the entry webpages at Entry into the Promotion is deemed acceptance of these Terms and Conditions.
The Promotion is open between 12:01am WST on 8 February 2010 and 11:59pm WST on 28 April 2010 ("Promotion Period"). There will be one draw at 12noon WST on 4 May 2010 (the “Draw”) being conducted by an independent person at the offices of Westnet Pty Ltd, Level 1, 502 Hay Street, Subiaco, WA 6008 from the eligible entries received during the Promotion Period. The Draw will be a random barrel draw from all eligible entries received during the entry period for the Draw.
The first correct eligible entry drawn (Referrer & Referee) will each receive $5,298 (retail value) worth of Samsung equipment. Each prize package includes a:
- Samsung Series 6 46inch LED TV (UA46B6000VF) valued at $3,799 (retail value); and
- Samsung 5.1 channel Blu-ray home theatre system (Ht-bd1255) valued at $1,499 (retail value).
Total retail value for the Draw is $10,596. This has been authorised under permit numbers: NSW Permit No LTPS/10/00632; VIC Permit No 10/98; SA Licence No T10/88; ACT Permit No TP 10/00159.2.
Winners will be notified within two days of the Draw. Every reasonable effort will be made to notify the relevant winners in writing at the number/address attached to their relevant internet account and email address provided in the referral process. Winners will also be published in The Australian newspaper on 10 May 2010.
Entry is open to Australian residents who are aged 18 years or over ("Eligible Entrants").
Management and employees (and their immediate families) of the Promoter and any agencies, firms or companies associated with the Promotion (including the suppliers of prizes) are ineligible to enter.
To enter and be eligible to win, an Eligible Entrant must satisfy the requirements of being either an Eligible Referrer or an Eligible Referee during the Promotion Period, as outlined below:
- Eligible Referrer must have an active and current Westnet account at the date of the Draw and must have referred an “Eligible Referee” to an Acceptable Westnet Broadband Service. Acceptable Westnet Broadband Service includes any of the Westnet broadband plans as outlined at www.westnet.com.au/internet/broadband/
- Eligible Referee must have successfully applied for, and maintained at the date of the Draw, an Acceptable Westnet Broadband Service through the Online Broadband Application Process or via telephone signup (the “Broadband Application”) and must provide a correct Westnet username during the Broadband Application process. No Eligible Referrer details will be accepted after the Broadband Application is completed.
An Eligible Referrer may enter the Draw with multiple entries based on each Eligible Referee referred.
An Eligible Entrant will be ineligible to win if, by the date of the Draw:
- they withdraw or otherwise cancel their Broadband Application; or
- they are in breach of the Acceptable Westnet Broadband Service terms and conditions; or
- for any reason their Broadband Application is rejected; or
- they are in arrears with their account.
Prizes can only be delivered to an address registered with the winners’ relevant Westnet account. If there are variations to this delivery address then delivery will be at the cost of the winner.
It is the responsibility of the winner to be available and at the registered address at the agreed time of delivery of the prizes otherwise it is at the cost of the winner to arrange for re-delivery.
The prizes are not transferable, divisible or exchangeable and cannot be redeemed for cash.
The Promoter accepts no responsibility for any variation in the retail value of the prizes. If the Promoter is unable to provide a winner with any element of a nominated prize, the Promoter reserves the right to supply an alternative prize of equal or greater monetary value, subject to relevant State or Territory legislation.
The Promoter accepts no responsibility for entries not received or included for any reason during the Promotion Period.
Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry process in any way, or who does not properly comply with the entry process, will be ineligible to win.
The judge's decision is final and binding and no correspondence will be entered into.
The Promoter is Westnet Pty Ltd ABN 50 086 416 908, Level 1, 502 Hay Street, Subiaco, Western Australia 6008 ("Promoter").
By participating in this Promotion participants understand and agree that Westnet Pty Ltd may use and disclose the information provided by them on the terms and for the purposes (including marketing) set out in Westnet’s Privacy Statement available at http://www.westnet.com.au/about/legal-information/privacy-policy.aspx.
The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these competition conditions. For any prize forfeited through ineligibility, the Promoter will conduct a further draw.
In the event of a prize not being claimed within 3 months of the relevant notice dates, the Promoter reserves the right to conduct a further draw(s) 3 months after the original draw at the same place as the original draw. The unclaimed prize draw will be conducted at 12 noon WST on 4 August 2010.
